A social contract.

1. Agreement

These Terms of Service (“Terms”) form a binding agreement between you and Ulysses Holding B.V., trading as Inweit, with an address at Stadhouderskade 125 2, 1074 AV Amsterdam, Netherlands (“Inweit”, “we”, “us”, or “our”), and govern your use of the Inweit iOS app, inweit.app, links.inweit.app, and related services (the “Service”).

By creating an account, accepting an invitation, or otherwise using the Service, you agree to these Terms and acknowledge the Privacy Policy. If you do not agree, do not use the Service.

2. Eligibility and accounts

You must be at least 16 years old and legally permitted to use the Service. If you are under 18, you represent that a parent or legal guardian has reviewed and authorised your use where applicable law requires it. You may not use the Service if we previously removed you for serious or repeated violations, unless we give written permission.

You must provide accurate information, use your own identity and current photo, keep access to your sign-in method secure, and promptly tell us about suspected unauthorised access. You may not transfer, sell, share, automate, or create an account for another person. You are responsible for activity performed through your account to the extent allowed by law.

3. The Service

Inweit is a map-first social service for discovering nearby context, sharing presence, creating and joining activities, communicating with participants, and finding places to meet. Features may depend on location, weather, connectivity, device permissions, invitations, trust status, and information supplied by other members or third parties.

We may add, change, limit, test, suspend, or remove features. We do not guarantee that the Service, a particular activity, a place, or another person will be available, accurate, safe, suitable, or uninterrupted. Inweit is not an emergency, navigation, transport, medical, or public-safety service.

4. Community rules

You may not use the Service to:

• Impersonate another person, misrepresent your identity, evade verification, or create deceptive accounts.
• Harass, stalk, threaten, shame, exploit, discriminate against, or endanger anyone.
• Share another person’s precise location, private information, image, messages, or content without authority.
• Post sexual exploitation material, non-consensual intimate content, credible threats, graphic violence, hateful content, scams, spam, or unlawful goods or services.
• Use the Service to arrange unlawful, dangerous, or non-consensual conduct.
• Probe, scrape, reverse engineer, overload, bypass access controls, defeat rate limits, distribute malware, or use automated means without our written permission, except where a legal right cannot be waived.
• Collect or use member data for advertising, surveillance, eligibility decisions, facial recognition, or building a competing database.
• Infringe intellectual-property, privacy, publicity, contractual, or other rights.
• Encourage, assist, or attempt any of the conduct above.

5. Your content

You retain ownership of content you submit to the Service (“Your Content”). You represent that you have the rights needed to submit it and that doing so does not violate law, these Terms, or someone else’s rights.

You give Inweit a worldwide, non-exclusive, royalty-free licence to host, store, reproduce, adapt for technical formatting, transmit, and display Your Content solely as needed to operate, secure, improve, and provide the Service according to your settings. This licence ends when Your Content is deleted from our active systems, except for copies that another member legitimately retains, short-lived backups, or records we must keep for legal or safety reasons.

Feedback and product suggestions may be used without restriction or payment, but we will not treat private content as public feedback.

6. Location, activities, and real-world safety

Location and presence can be sensitive. Share them only with people you trust, review your audience, use Ghost Mode or turn sharing off when appropriate, and remember that authorised viewers can capture what they see. Approximate or stale data may be shown, and GPS can be wrong.

You are responsible for deciding whether to create, join, attend, or leave any activity and for complying with venue rules, laws, age limits, permits, transport requirements, and ordinary safety precautions. Use judgment when meeting someone, tell a trusted person where you are, choose public places where appropriate, and contact local emergency services—not Inweit—if anyone is in immediate danger.

Inweit does not organise, supervise, endorse, insure, or control member-created activities. Hosts and participants are responsible for their own conduct. Verification is a safety signal, not a background check, identity warranty, or guarantee of good behaviour.

7. Reports, blocks, and enforcement

You can block and report members and content through the Service. We may investigate, preserve relevant records, restrict visibility or features, remove content, cancel activities, suspend accounts, or permanently terminate access when we reasonably believe there is a safety risk, legal requirement, breach of these Terms, abuse of the Service, or risk to other members or Inweit.

We may act without advance notice where delay could create risk or undermine an investigation. We are not required to monitor every interaction and cannot guarantee that all objectionable content will be found. Where appropriate, you may ask us to review an enforcement decision at support@inweit.app.

8. Inweit’s intellectual property

The Service, including its software, design, brand, logos, editorial copy, ranking systems, and original content, is owned by Inweit or its licensors and protected by intellectual-property law. Subject to these Terms, we grant you a personal, limited, revocable, non-exclusive, non-transferable licence to use the Service on devices you own or control for its intended purpose.

“Inweit” and its visual marks may not be used in a way that suggests endorsement or causes confusion without our written permission.

9. Third-party services

The Service relies on or links to services such as Apple, Google Firebase and Google Cloud, Google Maps and Places, and AWS Rekognition. Their content, availability, and independent processing are governed by their own terms and policies. Place details, directions, weather, opening hours, photos, and map data can be delayed or inaccurate; confirm important information directly with the relevant venue or provider.

10. Ending use and deleting your account

You may stop using the Service at any time. You can permanently delete your account inside Profile → Account → Delete account. Deletion is designed to remove your profile, relationships, hosted activities, messages, location, verification artefacts, and other linked data as described in the Privacy Policy.

We may suspend or terminate the Service or your access under Section 7. Provisions that by their nature should survive—such as ownership, disclaimers, liability limits, dispute terms, and obligations arising from earlier conduct—remain in effect.

11. Disclaimers

To the maximum extent permitted by law, the Service is provided “as is” and “as available”. Inweit disclaims implied warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, availability, and quiet enjoyment. We do not warrant the identity, statements, location, conduct, suitability, or safety of members; the quality or legality of activities; or the accuracy of third-party information.

Nothing in these Terms excludes warranties or consumer rights that cannot lawfully be excluded.

12. Limitation of liability

To the maximum extent permitted by law, Inweit and its operators, affiliates, officers, employees, contractors, and licensors will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages; loss of profits, data, goodwill, or opportunity; or harm arising from another member, an activity, a venue, location sharing, third-party content, or unauthorised access outside our reasonable control.

Where liability cannot be excluded, our aggregate liability arising from the Service will not exceed the greater of EUR 100 or the amount you paid Inweit during the 12 months before the event giving rise to the claim. This limit does not apply to fraud, wilful misconduct, gross negligence, death or personal injury caused by negligence, or any liability that applicable law does not allow us to limit.

13. Indemnity

To the extent permitted by law, you will indemnify and hold Inweit harmless from third-party claims, damages, and reasonable costs arising from Your Content, your unlawful use of the Service, your breach of these Terms, or your infringement of another person’s rights. This does not require you to indemnify us for our own negligence or unlawful conduct.

14. Additional Apple App Store terms

If you downloaded Inweit from Apple’s App Store, you acknowledge that these Terms are between you and Inweit, not Apple. Inweit, not Apple, is responsible for the Service, maintenance, support, and any product claims. Apple has no obligation to provide maintenance or support.

If the app fails to conform to an applicable warranty, you may notify Apple and Apple may refund the purchase price, if any; to the maximum extent permitted by law, Apple has no other warranty obligation. Inweit, not Apple, is responsible for addressing claims concerning the app, including product liability, regulatory, consumer-protection, and intellectual-property claims. You represent that you are not located in a country subject to a U.S. government embargo and are not listed on a U.S. government prohibited-party list. Apple and its subsidiaries are third-party beneficiaries of this section and may enforce it against you.

15. Governing law and disputes

These Terms are governed by the laws of the Netherlands, excluding conflict-of-law rules. The competent courts in Amsterdam, Netherlands have jurisdiction, unless mandatory consumer law gives you the right to bring or defend a claim before the courts of your place of residence or requires another forum. If you are a consumer in the European Economic Area, you also retain the protection of mandatory consumer law in your country of residence. Before filing a formal claim, you and Inweit agree to try in good faith to resolve it by written notice and 30 days of direct discussion.

Nothing here restricts your right to contact a regulator, seek urgent injunctive relief, or use a mandatory consumer dispute process.

16. Changes to these Terms

We may update these Terms as the Service and law change. We will post the new version here and update the effective date. For material changes, we will provide reasonable additional notice where possible. Continued use after the new Terms take effect means you accept them; if you do not, you must stop using the Service and may delete your account.

17. General

These Terms and the Privacy Policy are the entire agreement about the Service, unless we expressly agree otherwise in writing. If a provision is unenforceable, it will be adjusted only as much as necessary and the rest remains effective. A delay in enforcement is not a waiver. You may not assign these Terms without our consent; we may assign them as part of a reorganisation, financing, merger, or transfer of the Service, subject to applicable law. Headings are for convenience only.
